Roe v Wade
Unless you have been in a cave you know that a supreme document was leaked to the press purporting to overturn Roe v Wade. The opinion was written by Samuel Alito and appears to have the backing of 4 other justices. The supposed ruling, which is not finished has sent shock waves across the country on both sides of the debate.
The left is obviously indignant. There was a major breach of confidence in the court and possibly laws broken, but that is not where the outrage lies. What they are really upset about, Democrat politicians anyway, is that they will lose some of their power.
The ruling by the court will not ban abortions. No, the ruling will overturn Roe v Wade in a way that will let the states decide whether to allow abortion or not. The case that was brought to the court is a Mississippi law that only bans abortions after a heartbeat is detected. A heart beat is usually detected at about 6 weeks after conception. So, there is plenty of time to abort the pregnancy if desired. Texas has a similar law on the books and look for other states to pass similar measures.
Roe v Wade was a terrible ruling. In a 7-2 ruling the supreme court ruled abortion was legal under the 14th amendment of the constitution. Side bar, the left is screaming that abortion is being taken from women by men. There were no women on the court in 1973 when Roe was handed down, so that argument is silly. It's OK for seven men to declare it's constitutionality, but men cannot decide to overturn. Plus my guess is Amy Coney Barrett will side with the majority.
Democrats in congress are calling for abortions to be codified into law. I say go for it. That is the way a representative republic with checks and balances is suppose to work. I don't think they are genuine though. If they pass an abortion law, then they have no wedge issue and nothing to run on as far as abortion is concerned. Despite their feigned outrage, they are perfectly happy to be able to run on the fact they need more democrats in congress to pass abortion legislation.
I have seen people on the right rejoicing and I get it. Please stop with the line “I can't find the word abortion in the constitution.” This argument to me is saying that our only rights are in the constitution. No, the constitution limits the government's ability to take away rights, not grant them.
However the court rules, abortion will not go away. If the ruling comes as the leaked document seems, states will decide the issue. Some states will pass abortion bans completely. Some states will allow an abortion seven days after birth, as in the proposed law in California. Hopefully this ruling, if it holds, will foster a new era of federalism. The federal government has usurped too much power from the states. The 17th amendment to the constitution should be repealed to help get back to more federalism, but that is for another posting.
Hopefully this ruling will bring to light the moral aspect of abortion. It's never going to go away whether legal or illegal. We have to approach it from a moral standpoint. Abortion is nothing more than the killing of the innocent. Unless everyone understands this, abortion will never go away.
I pray for the justices ruling on this on either side. There may never be a decision from the court as contentious as this one.
